What Is a Notarial Contract?

A notarial contract (also called a notarial deed) is a legal document that must be drafted, signed and executed in the presence of a Notary Public. The notary’s signature and official seal confirm that:

  • The parties signed voluntarily
  • Their identities were verified
  • The document meets South African legal standards

Certain notarial contracts must also be registered at the Deeds Office to be legally enforceable.
